These Terms of Service ("Terms") govern your access to and use of the Trackovo mobile application, web dashboard, and related services (collectively, the "Service") operated by Trackovo ("we," "our," or "us").

By creating an account, downloading the app, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use Trackovo. By using the Service, you represent that you meet these requirements. Trackovo is designed for professional use by builders, contractors, interior designers, architects, project managers, and their teams.

2. Account Registration

To access the Service, you must create an account and provide accurate, complete information including your name, company name, mobile number, and email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at developer@trackovo.app if you suspect unauthorized access.

3. Service Description

Trackovo is a cloud-based construction and interior project management platform that provides tools for material management, GPS attendance, accounts and expenses, daily planning, labour and contractor management, measurement books, proforma and GST billing, performance tracking, client portals, and other related modules. The Service is available via a mobile application (Android) and a web dashboard.

4. Free Trial

We may offer a free trial period for new users. During the trial, you will have access to the Service features as described at the time of sign-up. No credit card is required for the trial. At the end of the trial period, your access may be limited unless you subscribe to a paid plan. We reserve the right to modify or discontinue the free trial at any time without prior notice.

5. Subscription & Payments

Paid plans may be offered on a monthly or annual basis. By subscribing, you agree to pay all applicable fees as displayed at the time of purchase. All fees are quoted in Indian Rupees (INR) unless stated otherwise. Payments are processed through third-party payment providers, and we do not store your payment card details directly. Subscription fees are non-refundable except where required by applicable law or as stated in our refund policy.

6. Your Data & Content

You retain ownership of all data, content, and information you submit to the Service ("Your Data"), including project details, material requests, attendance records, financial entries, photos, and documents. We do not claim any intellectual property rights over Your Data. By using the Service, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing and improving the Service. 7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Upload or transmit any malicious code, viruses, or harmful content.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Use the Service for any purpose other than legitimate business operations related to construction, interior, or project management.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Share your account credentials with unauthorized third parties.

We reserve the right to suspend or terminate your account if you violate these terms.

8. GPS & Location Features

Certain features of Trackovo, such as site attendance tracking and delivery verification, use GPS and location data. By enabling these features, you consent to the collection of location data as described in our Privacy Policy. You are responsible for informing your team members and employees about the use of GPS tracking and obtaining any necessary consents as required by applicable law.

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including Firebase, Google Cloud, payment gateways, and analytics providers. We are not responsible for the content, terms, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

10. Intellectual Property

All rights, title, and interest in the Service — including the software, design, logos, trademarks, documentation, and all related intellectual property — are owned by Trackovo and its licensors. These Terms do not grant you any right to use the Trackovo name, logo, or branding without our prior written consent.

11. Availability & Modifications

We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free access. We may modify, update, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes. Scheduled maintenance will be communicated in advance where possible.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Trackovo and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, business interruption, or any damages resulting from reliance on information provided through the Service. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that any errors will be corrected.

14. Indemnification

You agree to indemnify, defend, and hold harmless Trackovo and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

Either party may terminate these Terms at any time. You may stop using the Service and request account deletion by contacting us at developer@trackovo.app. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or engage in conduct that we determine is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately. We will retain Your Data for a reasonable period to allow you to export it, after which it may be permanently deleted.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Greater Noida, Uttar Pradesh, India. Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of thirty (30) days.

17. Google Ads & Cookies

We use Google Ads and similar advertising platforms to promote Trackovo. Google and other third-party vendors may use cookies to serve ads based on your prior visits to our website or other websites. 18. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
